This section contains the conditions governing bookings and stays at Refuxio da Carballeira®, our Internal Rules and the information relating to privacy, video surveillance, cookies and use of this website.

Making a booking implies acceptance of the applicable booking conditions and of these Internal Rules.

Our aim is to preserve the tranquillity that characterises Refuxio da Carballeira, ensure people’s safety, protect a space built mainly of wood and located in a natural setting, and facilitate respectful coexistence among all guests.

2. PURPOSE AND SCOPE

These conditions apply to bookings made directly with Refuxio da Carballeira®, particularly through our website and the integrated booking engine.

When a booking is made through Airbnb, [Booking.com](http://Booking.com) or another intermediary platform, the booking, payment and cancellation terms of the channel used shall apply to matters managed by that platform.

These Internal Rules shall apply during all stays at Refuxio da Carballeira®, regardless of the channel through which the booking was made, always within the limits established by applicable law.

The Rules are also available to users at the establishment.

3. BOOKING HOLDER

The person making a booking must be of legal age, have sufficient legal capacity to enter into a contract and provide complete, accurate and truthful information.

The booking holder shall be the main contact person with Refuxio da Carballeira and undertakes to inform all other members of the party about these rules.

All guests are individually required to comply with the Internal Rules.

The booking must reflect the actual number of people who will be staying.

The maximum authorised capacity of the relevant cabin may under no circumstances be exceeded.

4. CONFIRMATION OF THE BOOKING

A direct booking shall be confirmed once the booking process has been completed correctly and the booking holder has received the corresponding confirmation.

The booking documentation shall contain, at a minimum, the information required by law and, among other details:

- booking date;

- name of the booking holder;

- number of beneficiaries/guests;

- arrival and departure dates;

- cabin or type of accommodation booked;

- total price;

- advance payment, where applicable;

- payment method and conditions;

- cancellation policy;

- services or supplements booked;

- and any applicable special conditions.

Before completing the booking, the information entered can be reviewed and corrected where necessary.

If an error is detected afterwards, it must be reported to Refuxio da Carballeira as soon as possible.

5. PRICES

The applicable prices shall be those shown during the booking process.

Before the booking is confirmed, the total price for the selected services will be displayed, including legally applicable taxes.

Optional services, supplements or extras will only be charged when they have been booked or when they become payable as a consequence of any of the circumstances expressly provided for in these conditions.

6. BOOKING ENGINE AND PAYMENTS

Direct bookings made through our website are managed using the AvaiBook booking engine.

Payments shall be made using the payment methods available in the booking engine at the time of booking.

AvaiBook and the corresponding payment service providers may be involved in managing:

- payments;

- refunds;

- advance payments;

- pre-authorisations or deposits, where configured;

- and additional charges associated with a booking where applicable under the accepted conditions and the rules of the payment service.

Refuxio da Carballeira does not directly store the full bank card details used in the payment system.

The specific financial conditions applicable to each booking shall be those shown before the booking is completed.

7. CANCELLATION POLICY FOR DIRECT BOOKINGS

Unless a rate or offer expressly states different conditions before booking, direct bookings shall be subject to our limited cancellation policy.

Cancellation 14 days or more before arrival

100% of the refundable amounts paid in respect of the stay will be refunded.

Cancellation between 7 and less than 14 days before arrival

50% of the refundable amounts paid in respect of the stay will be refunded.

Cancellation less than 7 days before arrival

The booking shall be non-refundable, without prejudice to any mandatory rights that consumers may have under applicable law.

For the purpose of calculating these periods, 4:00 p.m. on the scheduled arrival date shall be used as the reference time.

Cancellation must be communicated by a procedure that provides evidence that it was made.

This policy shall apply to advance payments or amounts paid under the payment terms configured for the booking. Where a booking is not subject to an advance payment or prepayment, the mandatory regime established by applicable tourism regulations shall in any event apply.

Where the booking was made through an external platform, that platform’s cancellation policy shall apply.

8. RIGHT OF WITHDRAWAL

Bookings for tourist accommodation providing for a specific date or period of performance are excluded from the general fourteen-day right of withdrawal applicable to certain distance contracts.

Therefore, the possibility of cancelling a booking and its financial consequences shall be governed by the cancellation policy booked and by the applicable tourism and consumer legislation.

9. CANCELLATION BY REFUXIO DA CARBALLEIRA

If, exceptionally, Refuxio da Carballeira® has to cancel a booking due to a circumstance attributable to the establishment or for a reason that legally requires such cancellation, the corresponding amounts shall be refunded and, where applicable, the remaining consequences established by applicable tourism legislation shall apply.

In cases of force majeure, the relevant circumstances and the applicable legal provisions shall be taken into account.

10. MANDATORY GUEST REGISTRATION

All persons staying at Refuxio da Carballeira® must be properly identified and registered.

The data required by law will be collected in order to comply with the documentary registration and reporting obligations applicable to accommodation establishments.

Persons over 14 years of age must complete and sign the corresponding guest registration form using the enabled procedure.

The details of persons under 14 years of age shall be provided by the adult accompanying them.

Guests must provide or show the documents or systems required to properly verify their identity whenever legally required.

The required data shall be entered in the corresponding register and communicated to the competent authorities through SES.HOSPEDAJES or any system that legally replaces it.

Refusal to provide mandatory information, prove identity or complete the registration procedure may prevent accommodation from being provided.

11. SELF CHECK-IN

Refuxio da Carballeira® operates using a self check-in system, with no need for an in-person reception procedure.

Check-in is available from 4:00 p.m. on the booked arrival date.

There is no latest arrival time.

Before the stay, the necessary instructions will be sent by email, WhatsApp or another contact method provided in the booking in order to:

- locate the establishment;

- access the property;

- collect the barrier remote control;

- access the cabin;

- use the smart lock;

- and have the information needed to begin the stay.

Guests arriving after 10:00 p.m. must do so with particular respect for the quiet hours.

12. PROPERTY ACCESS REMOTE CONTROL

Vehicle access to the property is controlled by a barrier.

The corresponding remote control will be placed in a lockbox next to the entrance and must be collected following the instructions provided before arrival.

The remote control is provided solely for use during the stay and must be kept safe.

At the end of the stay, it must be returned to the indicated location.

Where the remote control:

- is not returned;

- is lost;

- is returned broken;

- becomes unusable due to impact, moisture or tampering;

- or is damaged as a result of improper use,

a replacement and administration charge of 60 € will apply.

This charge will not apply when the failure is due to ordinary wear and tear, a technical fault or any cause not attributable to the guests.

13. CABIN ACCESS AND SMART LOCK

Access to the cabins is by means of a smart lock.

Any codes, links, credentials or other access systems provided are intended exclusively for the persons included in the booking.

They must not be shared with third parties.

It is forbidden to tamper with, dismantle, force or attempt to reprogramme the locks or any other access device.

Any incident must be reported to Refuxio da Carballeira®.

14. NO-SHOW

Due to the self check-in system and the absence of a latest check-in time, the booking may remain available throughout the first booked night.

If by 12:00 noon on the day following the scheduled arrival date check-in has not taken place and there has been no communication from the booking holder, the booking may be considered a no-show and cancelled in accordance with the booked conditions and applicable law.

15. CHECK-OUT

Check-out must take place before 12:00 noon on the final booked day.

Any extension must be authorised in advance.

An unauthorised late departure that delays or prevents cleaning, maintenance or preparation of the accommodation for subsequent guests may result in a claim for the costs actually incurred.

Before leaving the establishment, guests must follow the instructions provided regarding:

- locking the cabin;

- returning the remote control;

- installed equipment;

- and any other basic check-out procedure.

16. QUIET HOURS AND NOISE

The quiet hours at Refuxio da Carballeira® are:

10:00 p.m. to 9:00 a.m.

During this period, any activity likely to disturb other people must be avoided.

In particular, guests must avoid:

- music audible from other cabins;

- shouting;

- loud conversations;

- noisy use of facilities;

- unnecessary vehicle noise;

- and any behaviour incompatible with rest and quiet.

Tranquillity is an essential part of the Refuxio da Carballeira® experience, so respectful behaviour towards other guests and the surroundings is also required outside these hours.

17. PARTIES, EVENTS AND UNAUTHORISED ACTIVITIES

The following are not permitted:

- parties;

- events;

- large celebrations;

- gatherings incompatible with the normal use of the accommodation;

- commercial activities;

- professional audiovisual productions;

- commercial photo shoots;

- or any use other than an ordinary tourist stay,

unless expressly authorised in advance by Refuxio da Carballeira.

18. VISITORS AND PERSONS NOT INCLUDED IN THE BOOKING

Persons not included in the booking may not enter or remain within the property, cabins, terraces or other areas reserved for guests without prior authorisation from Refuxio da Carballeira®.

This rule is based on reasons of:

- safety;

- privacy;

- tranquillity;

- occupancy control;

- compliance with registration obligations;

- and protection of the facilities.

An authorised visit does not constitute permission to stay overnight.

19. UNDECLARED ADDITIONAL GUESTS

Every person who will stay overnight must have been included and registered.

Where it is detected that a person not included in the booking is staying or intends to stay overnight in the accommodation, that person must be regularised immediately, provided this is lawful and does not result in the maximum authorised capacity being exceeded.

In that case:

1. the link or procedure required to complete their guest registration will be sent;

2. they must provide the information required by law;

3. and an exceptional supplement of 100 € for each night of stay of the undeclared additional person will apply.

This supplement shall replace the ordinary supplement that would have applied had the person been correctly added from the outset.

Exceeding the maximum capacity

Occupancy above the maximum authorised capacity of a cabin cannot be regularised by paying a supplement.

Therefore, if adding an additional person exceeds that capacity, that person must leave the accommodation.

Refusal to do so shall constitute a serious breach of the Rules.

Refusal to register

If a person who is staying overnight refuses to:

- identify themselves;

- provide the information required by law;

- complete the registration;

- or leave the establishment where their stay cannot be regularised,

Refuxio da Carballeira® may require them to leave immediately and, where necessary, request assistance from the Security Forces and Corps or report the facts to them.

20. NO SMOKING OR VAPING

Smoking is prohibited anywhere on the Refuxio da Carballeira® property.

The prohibition includes:

- inside the cabins;

- terraces and porches;

- gardens;

- paths;

- parking areas;

- entrances;

- common areas;

- and any other area within the boundaries of the property.

The prohibition also extends to electronic cigarettes, vaping devices and similar devices.

Discarding or leaving cigarette butts, ash or waste related to these products is also prohibited.

Where a breach causes odours, stains, burns, the need for extraordinary cleaning, professional treatment or any other damage, the corresponding evidenced costs may also be claimed.

21. FIRE AND FIRE PREVENTION

Refuxio da Carballeira® is located in a natural setting and its buildings are constructed mainly of wood.

For safety reasons, lighting fires or using unauthorised naked flames anywhere on the property is strictly prohibited.

The following, among others, are not permitted:

- bonfires;

- barbecues;

- candles;

- camping stoves;

- burners;

- torches;

- braziers;

- pyrotechnic materials;

- or equivalent devices.

The pellet stove installed in each cabin is authorised equipment and must be used exclusively in accordance with the instructions provided.

22. SPECIAL CARE OF WOOD

Wood is one of the principal construction and finishing materials at Refuxio da Carballeira®.

Particular care must be taken to avoid:

- making cuts, holes or perforations;

- nailing or fixing objects;

- using adhesives that may damage surfaces;

- placing extremely hot containers directly on wood;

- bringing flames or heat sources close to it;

- leaving spilled liquids for prolonged periods;

- using chemicals, dyes or aggressive substances;

- dragging furniture;

- striking cladding or joinery;

- and any use liable to cause damage.

Any accidental incident should be reported as soon as possible so that its consequences can be minimised.

Any damage attributable to improper or negligent use, or use contrary to these instructions, may be claimed.

23. PELLET STOVE

The stoves may be pre-programmed by Refuxio da Carballeira® to maintain a comfortable temperature.

Instructions for use may be sent before or during the stay.

Guests must restrict themselves to the controls expressly intended for user operation.

It is prohibited to:

- access installer settings;

- alter technical configurations;

- dismantle the stove;

- insert materials other than the authorised fuel;

- block air inlets or outlets;

- cover it;

- dry clothing on it;

- place flammable materials close to it;

- or attempt to repair a fault.

In the event of any malfunction, Refuxio da Carballeira must be contacted.

24. COFFEE MACHINE, SOFA BED AND OTHER EQUIPMENT

Before or during the stay, instructions may be provided regarding the use of:

- the fully automatic coffee machine;

- sofa bed;

- stove;

- smart lock;

- household appliances;

- and any other equipment that requires them.

These instructions form part of the rules governing use of the equipment.

Guests must not:

- dismantle appliances;

- force mechanisms;

- alter technical settings;

- insert products or materials other than those intended;

- or carry out repairs themselves.

In the event of doubt or an incident, Refuxio da Carballeira® must be contacted before continuing to handle the equipment.

The sofa bed may only be used as an additional sleeping place when the corresponding occupancy has been correctly included in the booking.

25. FURNITURE, TABLEWARE, TEXTILES AND HOUSEHOLD ITEMS

All furniture, decoration, tableware, glassware, small household appliances, bed linen, mattresses, towels and other equipment must be used for their intended purpose.

Reasonable wear and tear arising from a normal stay shall not be considered damage.

However, damage clearly exceeding ordinary use may be claimed, including:

- breakages;

- burns;

- cuts;

- losses;

- permanent stains;

- damage caused by chemical products;

- or deterioration requiring repair, professional treatment or replacement of the item.

Towels and textiles must not be used to:

- clean footwear;

- clean vehicles;

- clean animals;

- remove make-up or dyes where this may cause permanent damage;

- handle chemicals;

- or for other purposes incompatible with their usual use.

26. ORDINARY AND EXTRAORDINARY CLEANING

Normal cleaning after the stay is included in the accommodation.

Guests are not required to perform the duties of a professional cleaning service.

They are, however, required to use the cabin reasonably and avoid situations that clearly exceed ordinary tourist use.

Where extraordinary work is necessary and directly attributable to improper use, the evidenced costs may be claimed.

This may include, among other circumstances:

- abnormal accumulation of waste;

- bodily fluids or dirt requiring specialist treatment;

- stains requiring professional intervention;

- persistent odours;

- consequences of smoking;

- extraordinary dirt caused by animals;

- or any situation requiring additional services beyond normal cleaning between stays.

27. PETS

Refuxio da Carballeira® permits a maximum of one pet per stay and only in the cabin expressly designated for this purpose: Cabin 1.

The pet must:

- be declared when making the booking;

- be expressly included in it;

- and the ordinary supplement shown during the booking process must be paid.

The other cabins do not allow pets.

Undeclared pet

If a pet is brought into the pet-friendly cabin without having been included in the booking in advance, an exceptional supplement of 100 € per stay will apply instead of the ordinary pet supplement.

Pet in a non-pet-friendly cabin

If a pet is brought into any cabin where pets are not allowed, an exceptional supplement of 100 € per stay will likewise apply.

Payment of this amount does not authorise the animal to remain in a cabin where pets are not permitted.

The pet must be removed from that unit.

A move to the designated pet-friendly cabin may only take place where:

- there is availability;

- occupancy conditions are respected;

- and Refuxio da Carballeira® expressly authorises it.

Refusal to remove the animal shall constitute a serious breach of the Rules.

Liability for damage

The booking holder shall be responsible for damage or extraordinary cleaning requirements directly caused by the pet.

The ordinary or exceptional pet supplement does not cover material damage caused by the animal.

Where evidenced, the following may also be claimed:

- scratches;

- bites;

- damage to wood;

- doors or cladding;

- damage to sofas, mattresses or textiles;

- breakages;

- permanent stains;

- damage to gardens;

- odours requiring professional treatment;

- and any other deterioration exceeding ordinary use.

Animal waste must be picked up immediately.

The pet must be kept under appropriate control and must not be left unsupervised where there is a risk of disturbance, anxiety, damage or any other incident.

Beds, bed linen or textiles intended for guests must not be used for the animal.

Legally recognised assistance animals shall be governed by their specific regulations and shall not be treated as ordinary pets where the law so provides.

28. MINORS

Minors shall remain under the responsibility and supervision of the adults accompanying them.

Refuxio da Carballeira® is located in a natural environment where there may be:

- changes in level;

- dampness;

- vegetation;

- uneven ground;

- wildlife or insects;

- and other features typical of a rural setting.

Adults must exercise particular supervision outdoors, at entrances, in parking areas and in areas with changes in level.

29. WATER, DRAINAGE AND INSTALLATIONS

The installations must be used responsibly.

The following must not be disposed of in toilets or drains:

- wet wipes, even if marketed as biodegradable;

- sanitary pads;

- tampons;

- nappies;

- condoms;

- cotton buds;

- fats or oils;

- food waste;

- chemicals;

- or any material other than waste arising from normal sanitary use and toilet paper.

Damage, blockages or technical interventions directly resulting from incorrect use may be charged where they can be evidenced.

Taps must not be left running, nor should spills, flooding or abnormal consumption be caused negligently.

30. ELECTRICITY AND VEHICLE CHARGING

Tampering with electrical panels, protective devices, sockets, wiring or technical installations is not permitted.

Appliances that may compromise the safety or capacity of the installation must not be connected.

Electric vehicles may only be charged using a specifically designated charging point or with prior authorisation from Refuxio da Carballeira.

Ordinary cabin sockets must not be used to charge electric vehicles without authorisation.

31. PARKING AND VEHICLE MOVEMENT

Vehicles must be parked exclusively in the designated areas.

Within the property, vehicles must be driven at low speed and with particular attention to pedestrians.

It is prohibited to:

- block entrances or traffic routes;

- improperly occupy spaces allocated to another cabin;

- wash vehicles;

- carry out repairs or maintenance work;

- or cause spills.

Guests are responsible for locking their vehicles correctly and safeguarding items left inside them, without prejudice to any liability that may legally correspond to the establishment.

32. WASTE AND SURROUNDINGS

The property and its surroundings must be kept clean.

Waste must be deposited in the designated places.

It is prohibited to leave:

- rubbish;

- cigarette butts;

- glass;

- food;

- hazardous waste;

- or any other object

outside the areas intended for this purpose.

Plants, trees, gardens, stone features, paths and outdoor installations must not be damaged.

Wildlife must not be fed, chased or handled.

33. NATURAL ENVIRONMENT

The rural location of Refuxio da Carballeira® means that circumstances typical of a natural environment may occasionally be present, such as:

- insects;

- pollen;

- leaves;

- dampness;

- mud;

- wildlife;

- changes in weather;

- or sounds typical of a rural setting.

Their occasional and natural presence does not in itself constitute a defect in the accommodation.

The foregoing is without prejudice to Refuxio da Carballeira’s obligation to maintain the facilities in the conditions of cleanliness, conservation, safety and health required by law.

34. SAFETY

It is prohibited to tamper with, cover, disconnect, remove or disable:

- detectors;

- fire extinguishers;

- signage;

- electrical panels;

- alarm devices;

- locks;

- access systems;

- emergency equipment;

- or any other safety-related element.

Entrances and exit routes must not be blocked.

Any abnormality must be reported immediately.

35. STAFF ACCESS TO THE CABINS

Guests’ privacy will be respected during the stay.

However, authorised staff may enter a cabin when reasonably necessary in the event of:

- an emergency;

- fire or smoke;

- an alarm;

- a water leak;

- a serious breakdown;

- risk to persons or property;

- an urgent maintenance need;

- reasonable indications that serious damage is occurring;

- or compliance with a legal obligation.

Where there is no urgency, prior notice will be given whenever possible.

36. DAMAGE, BREAKAGES AND IMPROPER USE

Guests must use the facilities with due care.

Normal wear and tear resulting from an ordinary stay shall not be considered damage.

Damage may be claimed where it is reasonably attributable to:

- intentional conduct;

- negligence;

- improper use;

- breach of the Rules;

- or failure to follow the instructions provided.

This may include:

- damage to wooden structures or cladding;

- furniture;

- household appliances;

- locks;

- access remote control;

- mattresses;

- textiles;

- stove;

- coffee machine;

- sofa bed;

- electrical installations;

- water or drainage installations;

- security systems;

- gardens;

- outdoor equipment;

- and damage caused by pets.

37. ASSESSMENT OF DAMAGE

Any amounts claimed must be proportionate to the loss actually caused.

Depending on the circumstances, they may include:

- repair;

- technical intervention;

- parts;

- necessary technician travel costs;

- extraordinary professional cleaning;

- specialist treatments;

- replacement;

- transport;

- substitution where repair is not possible or reasonable;

- reprogramming of devices;

- and other costs directly linked to the incident.

Where serious damage objectively prevents a cabin from being used for a certain period, any additional direct losses that are legally recoverable and can be evidenced may also be claimed.

Arbitrary amounts or damage resulting from ordinary wear and tear will not be claimed.

38. PROCEDURE FOR DOCUMENTING AND CLAIMING DAMAGE

Where damage reasonably attributable to a stay is detected during or after that stay, Refuxio da Carballeira® will document the incident.

Depending on the circumstances, the following may be used:

- photographs;

- videos;

- description of the damage;

- available previous photographs;

- maintenance records;

- estimates;

- invoices;

- receipts;

- proof of purchase;

- proof of payment;

- technical reports;

- communications;

- access records;

- and any other legally admissible means of evidence.

Refuxio da Carballeira® will contact the booking holder whenever possible, informing them of:

1. the damage detected;

2. the available documentation;

3. the amount claimed;

4. and the method used to determine it.

Where the repair or replacement has not yet been carried out, an estimate may initially be provided.

Where it has already been carried out, the corresponding invoice, receipt or proof of payment may be provided.

39. PROCESSING DAMAGE CLAIMS THROUGH AVAIBOOK

For direct bookings managed through AvaiBook, Refuxio da Carballeira® may report the incident both to the booking holder and to AvaiBook, using the mechanisms provided by the platform and its payment system.

Where necessary, the following may be provided to process the incident:

- photographs of the damage;

- description of the events;

- repair or replacement estimate;

- invoice;

- proof of purchase or payment;

- communications with the guest;

- and any other documentation needed to substantiate the claim.

Where the payment system conditions, existing authorisation and applicable law allow a pre-authorisation, additional charge or other transaction associated with the booking, it will be processed using the procedures provided for this purpose.

Acceptance of these conditions does not constitute unlimited authorisation to make arbitrary charges to a bank card.

40. SPECIFIC CHARGES AND SUPPLEMENTS FOR BREACHES

The following financial conditions are expressly communicated before the stay:

Undeclared pet or pet brought into a non-pet-friendly cabin

100 € per stay.

This amount replaces the ordinary pet supplement, without prejudice to any additional evidenced damage or extraordinary cleaning costs.

Undeclared additional guest

100 € per person per night.

This may only be regularised where the maximum authorised capacity of the cabin is not exceeded. The person must immediately complete their guest registration.

If the maximum capacity is exceeded, the person must leave the accommodation.

Barrier remote control lost, not returned or rendered unusable for a reason attributable to the guest

60 €.

These amounts are independent of any additional material damage that may have occurred.

41. SERIOUS BREACH OF THE RULES

Refuxio da Carballeira® may require the immediate cessation of any conduct contrary to these rules.

The following may be considered particularly serious:

- putting people or property at risk;

- lighting fires or using prohibited flames;

- smoking or vaping anywhere on the property;

- tampering with safety devices;

- engaging in violence, threats or intimidation;

- carrying out unlawful activities;

- deliberately bringing in unregistered persons;

- exceeding the authorised capacity;

- refusing to regularise an accommodated person;

- bringing in a pet in breach of the established conditions and refusing to remove it;

- holding unauthorised parties or events;

- causing serious or repeated disturbance;

- causing intentional or serious damage;

- or persistently disobeying legitimate instructions relating to the safety and proper operation of the establishment.

Where legally permissible, a serious or repeated breach may result in the early termination of the stay and a requirement to leave the establishment.

Where necessary, assistance from the Security Forces and Corps may be requested.

Any refund for unused nights will be determined according to the reason for termination, the circumstances of the case and applicable law.

All such measures shall be applied proportionately and without discrimination on any legally protected ground.

42. BREAKFAST AND COMPLIMENTARY PRODUCTS

Refuxio da Carballeira® leaves a selection of breakfast items and other complimentary products in the cabins.

The selection may be found both in the kitchen and in the refrigerator.

Food products are provided packaged and with the corresponding labelling, where their ingredients, allergens and other information supplied by the manufacturer can be consulted.

The products usually included contain foods that contain gluten and milk/lactose.

Persons with:

- allergies;

- intolerances;

- coeliac disease;

- lactose intolerance;

- or any other dietary requirement

must individually check the labelling before consuming each product.

The specific selection may vary depending on availability, season or replacement with equivalent products.

Unless expressly confirmed in advance, Refuxio da Carballeira® does not guarantee that breakfast will be suitable for a particular allergy, intolerance, diet or dietary requirement.

If in doubt, the relevant product should not be consumed until its composition has been checked.

43. FORGOTTEN ITEMS

If a person believes they have left an item behind after their stay, we recommend contacting Refuxio da Carballeira® preferably within 72 hours of departure.

We will carry out the reasonable checks necessary and try to locate it.

Recovery cannot be guaranteed for items whose presence cannot be verified or which have not been found.

If the item is located, the procedure for its recovery will be agreed with its owner.

Shipping, courier or transport costs shall be borne by the owner unless otherwise agreed.

Perishable products, opened food or items which it is not reasonable to keep for hygiene or safety reasons may be discarded.

The recommendation to report a forgotten item within the first 72 hours is for operational purposes and does not in itself entail the loss of any legal rights over a found item.

44. BREAKDOWNS AND SUPPLY INTERRUPTIONS

Refuxio da Carballeira® will take reasonable measures to keep the facilities and services in proper working order.

Exceptionally, incidents beyond the establishment’s control may occur, such as:

- general power cuts;

- external telecommunications problems;

- network or utility failures;

- extreme weather events;

- restrictions imposed by authorities;

- emergencies;

- or force majeure events.

Reasonably possible measures will be taken to resolve or minimise their consequences.

An external, brief incident not attributable to the establishment does not in itself create an automatic right to compensation, without prejudice to any rights that may legally apply where it substantially affects the contracted service.

45. VIDEO SURVEILLANCE

For security reasons, certain outdoor areas of Refuxio da Carballeira® are subject to video surveillance.

The cameras may cover:

- cabin entrances;

- vehicle access road;

- pedestrian access;

- circulation areas;

- and certain common areas.

There are no cameras inside the cabins or in areas intended for personal privacy.

Video surveillance is intended to protect people, property and facilities.

The existence of cameras will be indicated by the corresponding information signs.

Consent to advertising is not required in order to make a booking.

Guest registration and SES.HOSPEDAJES

Certain data must be processed and communicated to the competent authorities in compliance with the rules on documentary registration and information relating to travellers.

The legally required electronic register shall be retained for three years from the end of the contracted service or provision.

The corresponding notifications shall be made to the competent authorities within the legally established periods.

This processing is carried out in compliance with a legal obligation and does not depend on the guest’s consent.

AvaiBook and service providers

Technology providers may be involved in providing our services, including:

- payment service providers;

- website hosting and maintenance;

- email services;

- communication systems;

- IT services;

However, the definitive conditions applicable to a booking shall be those displayed during the booking process and in the corresponding confirmation.

Photographs are for information purposes and represent the general characteristics of the establishment.

Minor variations may occur due to:

- maintenance;

- replacement of equipment;

- renewal of furniture or textiles;

- decoration;

- seasonality;

- or availability,

provided that they do not substantially alter the characteristics of the contracted service.

50. INTELLECTUAL AND INDUSTRIAL PROPERTY

The texts, photographs, logos, trademarks, graphic elements, design, videos and other content of this website are owned by Refuxio da Carballeira, S.L. or are used with the corresponding authorisation.

Their reproduction, distribution, transformation, public communication or commercial use is not permitted without authorisation, except where legally allowed.

Complaints will be answered as soon as possible and, in all cases, within the maximum legal period of 15 days from submission.

Where a complaint made directly to Refuxio da Carballeira® cannot be resolved satisfactorily, the consumer may use any alternative dispute resolution mechanisms that are legally applicable.

52. LIABILITY

Refuxio da Carballeira shall be liable for obligations and damage that are legally attributable to it.

Nothing in these conditions is intended to exclude, limit or require the consumer to waive rights that apply mandatorily.

Refuxio da Carballeira® shall not be liable for damage whose cause is exclusively attributable to:

- use contrary to instructions;

- negligent conduct by the user;

- unauthorised tampering with installations;

- breach of the Rules;

- or events beyond the establishment’s control where no legal liability exists.

53. GOVERNING LAW AND JURISDICTION

These conditions shall be governed by the applicable Spanish and Galician law and, in particular, by the legislation in force concerning:

- tourism;

- consumer protection;

- electronic contracting;

- data protection;

- electronic commerce;

- public safety and guest registration.

54. ACCEPTANCE OF THE CONDITIONS

Before making a direct booking, the contracting person will have access to these conditions and will be able to consult and retain them.

The booking process will require express acceptance of the Booking Conditions and Internal Rules through the mechanism provided in the booking engine.

Acceptance includes acknowledgement of:

- the cancellation policy;

- check-in and check-out times;

- the self check-in system;

- quiet hours;

- occupancy rules;

- the registration obligation;

- pet rules;

- the prohibition on smoking and using fire;

- rules on the use of facilities;

- the damage policy;

- and the specific charges provided for in these conditions.

Refuxio da Carballeira® may retain the information necessary to evidence:

- the date and time of booking;

- the version of the conditions accepted;

- the price;

- occupancy;

- services booked;

- cancellation policy;

- and acceptance of the conditions.

The version applicable to each booking shall be the version in force at the time it is made.

Subsequent amendments shall not unilaterally alter a booking already made, unless legally mandatory or more favourable to the consumer.

55. SUMMARY OF PARTICULARLY IMPORTANT CONDITIONS

For ease of reference, some of the essential conditions of the stay are set out below:

Check-in: from 4:00 p.m., with no latest arrival time.

Check-out: before 12:00 noon.

Quiet hours: from 10:00 p.m. to 9:00 a.m.

Arrival: self check-in.

Smoking and vaping: prohibited throughout the property.

Fire and barbecues: prohibited.

Parties and events: not permitted.

Visitors: not permitted without authorisation.

Guests staying: all must be declared and registered.

Undeclared additional guest: 100 €/person/night, only where they can be regularised without exceeding the authorised capacity.

Exceeding capacity: the additional person must leave the accommodation.

Pets: maximum of one and only in the designated cabin, subject to prior declaration and payment of the corresponding supplement.

Undeclared pet or pet in a non-pet-friendly cabin: 100 €/stay, without prejudice to additional damage.

Access remote control lost, not returned or damaged through misuse: 60 €.

Damage: will be claimed where it exceeds normal use, is attributable to the stay and can be evidenced.

Construction: the cabins are built mainly of wood and require special care.
